Terms and conditions

Within the Baetsen Group, various activities are executed by different operating companies. All activities to be executed by Baetsen are governed by the following terms and conditions, depending on the nature of the activities:

 

  • The General Terms and Conditions of the Baetsen Group (version of March 2017), filed with the Registry of the Court in Rotterdam, supplemented where necessary with the following terms and conditions:
  • Waste acceptance: Waste Acceptance Regulations of the Baetsen Group (version of March 2017), filed with the Registry of the Court in Rotterdam.
  • Domestic transport: General Transport Conditions (AVC 2002, as amended in 2015), filed with the Registry of the Courts in Amsterdam and Rotterdam.
  • Cross-border transport: Convention on the Contract for the International Carriage of Goods by Road (CMR) and, in addition to this, the aforementioned AVC.
  • Exceptional transport:
    • Domestic transport is governed by the General Terms and Conditions for Exceptional Transport (AVET), filed with the Registry of the Courts in Amsterdam and Rotterdam, and, in addition to this, the aforementioned AVC.
    • International transport is governed by the CMR Convention and, in addition to this, the aforementioned AVET and AVC.
  • Storage and transshipment activities, as well as other forwarding activities, are governed by the Dutch Forwarding Conditions (General Terms and Conditions of FENEX), filed with the Registry of the Courts in Amsterdam, Rotterdam, Arnhem and Breda on 1 July 2004.
  • Vertical transport: General Terms and Conditions of the Vertical Transport Association (VVT), version of January 2010, filed with the Registry of the Courts in Amsterdam and Rotterdam. 

 

With regard to purchases by the Baetsen Group, Baetsen operates General Purchase Conditions (version of March 2017), filed with the Registry of the Court in Rotterdam.

 

With regard to the above terms and conditions, the version as placed on this page (www.baetsen.com/termsandconditions) applies at all times. The terms and conditions will be sent to you free of charge immediately on request, and you can also download the terms and conditions below. 

 

 

Furthermore, Dutch law applies exclusively, and the Court in Rotterdam has authority to hear any disputes.

In the event of disputes over the interpretation of versions of the aforementioned terms and conditions which are not in Dutch, the Dutch text will take precedence.
